Car Accident — I was hit and now what?

Car accident? Let the frustration begin! I know this because I was in one last week, and I did not know what to do or how to react.

I was a claim adjuster for several years before I went to law school, and even tough I handled hundreds of insurance claims alike, I never could comprehend how confusing a car accident really is.

Last week, I was sitting at a light when suddenly there was a “bum” and then another “bum”. My seat broke and I was laying flat. I got up and I could not find my hazard lights, and I could not remember where I was going. Everything was simply a daze. I just look at my car and realized there was no way I could drive home.

When the insurance adjuster called me and I told him what you just read, I could feel the frustration of the adjuster. The adjuster’s questions in the recorded statement were very detailed. I must have sounded like the biggest idiot.

Mr. Quiroga, what is the name and badge number of the police officer that responded to the car accident scene?

uh? I was there and then and I was hit and I could not find my hazard lights and my seat was broken. That was my answer!

Ok, you get my point. A car accident happens and we just do not know what to do. I did not know and I had been dealing with every possible car accident you could imagine.

Here are the 10 most valuable tips I came up with:

1. Get out of the vehicle only if you believe you are ok and/or if there is smoke.

2. Make sure that others are ok. Ask the other driver.

3. Be careful with what you say. Many adjusters will change your words to make it sound like you were apologizing for the accident because you were at fault. So a simple question like: is every one ok in your vehicle? will do the work.

4. Call the police. You need to call the police to the accident scene. Do not trust others. In many accidents people will tell you that they call and never did.
5. Exchange insurance information with the other driver.

6. Do not move the vehicle even if you are blocking traffic. Let the police take a look at the scene and let them determine when to move the vehicle.

7. If it is possible, CALL the other person’s insurance carrier and determine if there is an active policy in force that would cover your car accident. If not, tell the police officer.

8. Do not argue. Just listen and go sit down in your car if the other person is being anxious.

9. Whenever you have the chance, report the accident to your insurance company. Most insurance agents will tell you that if the accident is minor to deal directly with the other party so your rates do not go up. In my opinion, this can backfire on you.
If the other party starts claiming an injury (even if it is frivolous) and you failed to report the loss, Insurance companies can decline coverage because you breached your duty to report as outlined in most insurance polices. By reporting the car accident to your carrier, you are putting in notice of the loss. You can tell them that you will negotiate with the other party but if things get ugly, you will contact them.

10.If the accident was of substance. Go see a doctor. When you are in a car accident, the adrenaline rush is great and it will hide any pain or injury. It is better to detect any injury or complication early on.

Photo radar appears to be a license for the wealthy to speed.

There are no consequences to getting caught by photo radar. You pay and get away. You do not go to court and your insurance rate never goes up.

When pulled over and ticketed by a police officer your insurance rate will skyrocket. Tickets from photo radar have no insurance consequences, as the ticket is assigned to the car, not the driver.

Drivers who get pulled over and ticketed by the police are charged under the Highway Traffic Act and suffer the consequences of increased insurance costs, and possible policy cancellation. This is a strong deterrent and keeps our roads safer.

Photo radar results in fewer police patrolling the streets. So “cheers” to the drunk driver. Three tickets by photo radar may cost the drunk driver a few hundred dollars. If you are planning to fight the ticket, it’s good to know that the radar device is used to corroborate what the officer saw. Did the police officer see you speeding? Further, you don’t want to make the police officer’s documentation that thorough as a result of your cross examination. Save it for court.

Red Light Cameras: Red light cameras are used to catch drivers who run red lights. The negative consequences are that drivers use poor judgment of whether or not to go through a yellow light. Knowing that there is a red light camera can result in violent braking, which can cause an accident instead of avoiding one.

The ticket does not affect your insurance because it’s assigned to the vehicle, as the driver’s identity cannot be confirmed.

Medicaid

If you’re in a low income bracket, your state has a Medicaid program that will provide medical insurance for you and your family if your qualify. Medicaid medical insurance provides coverage for dental care, eye care, health care, and prescription drugs. If you don’t qualify for Medicaid, your next step is to go shopping for an inexpensive health care plan. There are two types of insurance that offer the most benefits for the least amount of money – HMOs and PPOs:

HMOs (Health Maintenance Organizations)

HMOs charge a fixed monthly fee for which they provide medical services that include doctor visits, hospitalization, surgery, and prescription drug coverage. Members must choose a primary car physician who oversees their health care, and they can only receive medical treatment from doctors and facilities that are part of the HMO’s network.

PPOs (Preferred Provider Organizations)

PPOs are similar to HMOs in that you receive medical services through a prescribed network of physicians and facilities. But unlike HMOs, members do not need to get permission from their primary care physician to see a specialist. PPOs cost about 5% more than HMOs.

Cheap Medical Insurance Rates

You can call local insurance companies or go to individual insurance sites to get medical insurance rate quotes, but the easiest way to get quotes is to go to an insurance comparison website.

Insurance comparison sites let you get quotes from a number of insurance companies. You want to get at least three quotes, then choose the quote that’s best for your circumstances.
